1. Introduction

DealScope LLC, doing business as Nutrivox ("we", "us", or "our"), operates the Nutrivox platform at nutrivox.ai. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use our Service. By using Nutrivox, you consent to the practices described in this policy.

2. Information We Collect

Account Information: Name, email address, company name, and phone number provided during registration.

Lead Data: Contact information, conversation history, and notes you store about your leads. This data is uploaded and managed entirely by you.

Message Content: SMS messages sent and received through the Service, including AI-generated draft replies.

Usage Data: Information about how you interact with the Service, including pages visited, features used, and timestamps.

Payment Information: Billing details are processed securely by Stripe. We do not store credit card numbers on our servers.

3. How We Use Your Information

We use collected information to: provide, maintain, and improve the Service; process transactions and send billing notifications; generate AI-powered message drafts based on conversation context; extract insights from conversations for the Memory Vault feature; send service-related notifications; respond to support inquiries; and detect and prevent fraud or abuse.

4. AI Processing

The Service uses OpenAI's API to generate message drafts and extract conversation insights. AI-generated content may contain errors, inaccuracies, or inappropriate suggestions — you must review all AI outputs before sending. Conversation data sent to OpenAI is processed according to OpenAI's usage policies. We do not use your data to train AI models.

5. SMS / Text Messaging Consent & Disclosure

What is Nutrivox?Nutrivox is an AI-powered CRM platform that enables real estate agents to communicate with prospective home buyers and sellers ("Leads") via SMS text messages. Messages are sent on behalf of the real estate agent through the Nutrivox platform using Twilio's messaging service.

How Consent is Obtained:Leads opt in to receive SMS messages in one of two ways: (1) by initiating a text message to a real estate agent's Nutrivox-powered phone number, which constitutes implicit consent to receive a reply; or (2) by submitting a contact or inquiry form on the agent's website that includes clear SMS consent language.

Types of Messages:Messages sent through Nutrivox include: responses to property inquiries, appointment and showing scheduling, follow-up communications about listings, and transactional updates related to the Lead's real estate inquiry. Nutrivox does not send marketing blasts, promotional offers, or unsolicited messages to consumers who have not initiated contact or opted in.

Message Frequency: Message frequency varies based on Lead activity and conversation context. Typically, Leads receive 1–5 messages per conversation. Automated follow-up sequences, if enabled by the agent, may send up to 1 message per day for the duration of the sequence.

Message and Data Rates:Standard message and data rates may apply depending on the Lead's mobile carrier and plan. Nutrivox does not charge Leads for receiving messages, but carrier fees may apply.

Opt-Out / STOP: Leads may opt out of receiving SMS messages at any time by replying STOP to any message. Upon receiving a STOP request, opt-out will be processed immediately and no further messages will be sent to that phone number. Leads may also reply HELP to receive support information. Standard message and data rates may apply to STOP and HELP messages.

Consent is Not a Condition of Purchase: Providing consent to receive SMS messages is not a condition of purchasing any property or service.

No Sharing for Marketing: We do not share, sell, or distribute phone numbers or SMS consent with any third party for marketing or promotional purposes. Phone numbers are used solely for facilitating communication between the Lead and their real estate agent through the Nutrivox platform.

TCPA Compliance: All SMS messaging through Nutrivox is conducted in compliance with the Telephone Consumer Protection Act (TCPA), the CAN-SPAM Act, and applicable state regulations. TCPA consent records and SMS logs are retained for a minimum of 5 years for compliance and audit purposes.

6. Third-Party Services (Subprocessors)

We use the following third-party services that may process your data: Twilio (SMS delivery), OpenAI (AI text generation), Stripe (payment processing), Clerk (authentication), Inngest (background job processing), and Neon (database hosting). Each service processes data according to their own privacy policies.

If we add new subprocessors that handle your data, we will update this policy and notify you via email at least 30 days before the change takes effect. You may object to a new subprocessor by contacting us within that 30-day period.

7. Data Storage and Security

Your data is stored on secure servers provided by Neon (PostgreSQL). We implement industry-standard security measures including encryption in transit (TLS 1.2+), access controls, and regular security reviews. However, no method of electronic storage is 100% secure, and we cannot guarantee absolute security.

8. Data Retention

We retain your data for as long as your account is active or as needed to provide the Service. Upon account deletion, we will delete your personal data within 30 days, except where retention is required by law. SMS message logs and TCPA consent records are retained for up to 5 years for regulatory compliance and audit purposes.

9. Data Sharing

We do not sell, trade, or rent your personal information to third parties for marketing or promotional purposes. We may share information with: third-party service providers who assist in operating the Service (listed in Section 6); law enforcement when required by law or to protect our rights; and in connection with a merger, acquisition, or sale of assets, with notice to you.

10. Your Rights

You have the right to: access, update, or delete your personal information; export your data in a machine-readable format; opt out of marketing communications; and request information about the data we hold about you.

California Residents (CCPA):Under the California Consumer Privacy Act, you have the right to: know what personal information we collect and how it is used; request deletion of your personal information; opt out of the sale of personal information (we do not sell your data); and not be discriminated against for exercising your CCPA rights. To submit a CCPA request, email us at support@nutrivox.ai with the subject line "CCPA Request." We will respond within 45 days.

Data Deletion Requests: To request deletion of your data, email support@nutrivox.ai with the subject line "Data Deletion Request." We will process your request within 30 days. Certain data may be retained where required by law (e.g., SMS compliance records, billing records).

11. Lead Data (Your Customers)

You are the data controller for any lead information you upload to the Service. You are responsible for obtaining proper consent from your leads before storing their information and sending them messages. We act as a data processor on your behalf and process lead data only as necessary to provide the Service. If you require a Data Processing Agreement (DPA), please contact us at support@nutrivox.ai.

11a. Data Retention & Deletion

We retain your data only as long as needed to provide the Service or comply with legal obligations. Specifically:

  • Account data (login, billing, settings) — retained for the life of your subscription plus 30 days after cancellation, then permanently deleted.
  • Lead profile data — retained for the life of your subscription. You may delete individual leads at any time from the dashboard, which removes them within 24 hours.
  • Message history — retained for 24 months from the send date for compliance and audit purposes, then automatically deleted unless a longer retention is required by law.
  • Opt-out records — retained indefinitely (as required by TCPA) so we never re-contact a number that has unsubscribed.
  • Backups — encrypted backups are retained for up to 35 days and then overwritten.

You may request export or deletion of your data at any time by emailing support@nutrivox.ai. We will complete verified deletion requests within 30 days.

12. Cookies

We use essential cookies for authentication and session management. We do not use advertising or tracking cookies. Third-party services (Clerk, Stripe) may set their own cookies as described in their privacy policies.

13. Children's Privacy

The Service is not intended for use by anyone under 18 years of age. We do not knowingly collect personal information from children.

14. Changes to This Policy

We may update this Privacy Policy from time to time. We will notify you of any material changes by email or through the Service at least 30 days before changes take effect. For material changes, we may require you to re-accept the updated policy. The updated policy will be effective upon posting.
